Privacy Policy for the App "Bettertained"

1. Controller

The Controller for the purposes of the GDPR is:

2. Data Collection upon Registration (Social Login)

To use the app, you must log in. We exclusively use third-party authentication tokens for this purpose. We do not store any passwords.

A. Sign in with Apple

If you sign in with your Apple ID, we receive the following data from Apple Inc.:

• A unique User Token (Apple ID Identifier).

• Name (if you have permitted sharing).

• Email address (or a relay address generated by Apple, e.g., privaterelay.appleid.com, if you choose to hide your email).

B. Google Sign-In

If you sign in with your Google Account, we receive the following data from Google LLC/Google Ireland Ltd.:

• Google ID.

• Email address.

• Name and profile picture (if public).

3. Hosting & Backend Infrastructure

For the operation of the app and the storage of data, we use external service providers (processors) with whom we have concluded corresponding data security agreements:

• Database: Neon Database (Neon Inc., USA)

• Backend Infrastructure: Vercel (Vercel Inc., USA)

Insofar as data is transferred to the servers of these providers in the USA, we rely on the EU-US Data Privacy Framework (if the providers are certified) or on Standard Contractual Clauses (SCC) of the EU Commission to ensure an adequate level of data protection.4. AI Processing & Recommendations (NEW)

We use Artificial Intelligence models ("LLMs") to generate personalized film and series recommendations.

Providers Used:

• Mistral AI (Mistral AI S.A.S., France – Server location EU)

• We reserve the right to use other providers in the future, such as Google (Gemini) or Anthropic (Claude), in compliance with comparable data protection standards.

Type of Processing: We send your input (e.g., selected genres, mood parameters, film titles on your Watchlist) to the AI provider's API. Important: This data is transmitted pseudonymously. The AI provider does not receive any direct identification features from us, such as your name, email address, or IP address.

No Training: We have ensured (e.g., through API settings or contracts) that your data will not be used by the AI providers to train their AI models. Your input is used exclusively to generate your personal recommendation at the moment of the request.

Legal Basis: Art. 6 para. 1 lit. b GDPR (Performance of a contract – since the AI recommendation is the core of our service).

5. Usage Profile & Personalization (Core Function)

The main function of "Bettertained" is to suggest content that you might like. For this purpose, we store and process the following data to enrich an individual user profile:

• Preferences (Onboarding): The genres and preferences you selected during registration.

• Situational Data (Mood Capture): Information about your current mood or situation that you enter in the app to receive suitable suggestions.

• Interaction Data: Information about which content you like ("Likes"), reject ("Dislikes"), place on your watchlist ("Watchlist"), or click on.

Purpose of Processing:

This data is used to train our recommendation algorithm and to display personalized content suggestions to you.

Legal Basis:

Art. 6 para. 1 lit. b GDPR (Fulfillment of the user contract). Since you use the app to receive personalized recommendations (see § 3 GTC), this data processing is strictly necessary for the provision of the service.

6. Analysis & Product Improvement (PostHog)

We use the PostHog service to improve our app and analyze errors.

We place great emphasis on data protection: We use an instance with Data Residency in Germany/EU. Usage data (e.g., which screens were accessed, crash reports) is collected to fix technical errors and optimize the user experience. IP addresses are processed anonymously.

Legal Basis: Art. 6 para. 1 lit. f GDPR (Legitimate interest in an error-free and user-friendly app).

7. App Permissions

The app only accesses functions of your device if this is necessary for use or if you have explicitly consented (e.g., for push notifications for new recommendations). You can revoke these permissions at any time in your operating system settings.

8. Data Deletion & Storage Duration

We store your profile and interaction data as long as your account exists, as this is necessary for the ongoing personalization of recommendations.

You can independently remove your account and all associated data at any time in the app under "Settings > Delete Account." The data will then be deleted immediately from our live systems.

9. Your Rights

You have the right to access stored data, rectify inaccurate data, deletion ("Right to be Forgotten"), restriction of processing, and data portability. Please contact info@bettertained.com for this purpose.
